These Terms of Service (“Terms”) govern your access to and use of the TopDog Boosting website and any services offered through it (the “Online Service”). These Terms also incorporate, by reference, the TopDog Boosting Privacy Policy. By accessing the Website, placing an order, or using any part of the Online Service, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the Website or place an order.

IMPORTANT NOTICE: Boosting, account access, or similar services may violate the terms of service of game publishers or platform providers. By purchasing or using the Online Service, you acknowledge and accept all risks related to enforcement actions by third parties, including but not limited to suspensions, bans, resets, loss of items, or loss of progress. TopDog Boosting does not guarantee any particular outcome.

2.1 You must be at least eighteen (18) years of age to access the Website or place an order.

2.2 By using the Website or placing an order, you represent and warrant that: (a) you have the legal capacity to enter into a binding agreement; (b) you have not been previously banned from the Online Service; (c) your use complies with all applicable laws; and (d) all Information you provide is accurate and complete.

2.3 We may refuse service, cancel orders, or restrict access at our sole discretion, including for fraud prevention, abuse prevention, or operational reasons.

3. Orders, Ticket ID, and Support

3.1 Orders are placed through the Website and paid via approved payment processors.

3.2 After payment, you must open a support ticket (typically via Discord) using your Ticket ID to initiate service. If you do not open a ticket, service may be delayed or may not begin.

3.3 You are responsible for monitoring the communication channel you provide (e.g., Discord). Failure to respond may delay completion.

3.4 We may request additional details to complete your order. If you refuse or do not provide requested information within a reasonable time, we may pause or cancel the order.

4. User Responsibility for Accuracy

4.1 You are solely responsible for ensuring all Information provided is correct at the time of purchase.

4.2 We do not verify ownership or authorization of game accounts. Providing false, misleading, stolen, or unauthorized account information may result in cancellation without refund.

4.3 Errors or changes in Information may cause delays, require additional work, lead to partial completion, or result in additional charges.

5. Service Performance and Estimated Times

5.1 Any completion time estimates are non-binding and may vary due to queue volume, rank difficulty, account performance, game updates, outages, or other factors.

5.2 We may pause or reschedule work for safety, quality control, or operational reasons (including booster availability).

5.3 If you play on the account during an active boost and it affects progress (e.g., losing rank, changing settings, consuming items), you accept responsibility for resulting delays and additional work.

6. Add-ons, Price Changes, and Extra Charges

6.1 Prices, packages, and availability may change at any time and apply only to future orders.

6.2 Additional charges may apply if the order’s workload increases due to inaccurate Information, unusually low gain per match, unexpected restrictions, or other factors outside our control. We will attempt to notify you before additional charges are incurred when practical.

7. Use of User Information

7.1 By providing Information, you authorize us to collect, store, and use such Information solely for: (a) processing payments; (b) performing the Online Service; (c) communicating with you; and (d) complying with legal obligations.

7.2 We do not sell your Information. We may share Information with Boosters and service providers only as necessary to perform the Online Service, and with payment processors to process transactions, or as required by law.

8. Third-Party Services and Platforms

8.1 The Website may reference or link to third-party services (including Discord, Stripe, or game publishers). We do not control and are not responsible for their content, policies, or availability.

8.2 Payments are processed by third-party payment processors. We are not responsible for processor errors, fraud checks, outages, bank actions, card issuer decisions, or delays caused by third parties.

9. Prohibited Conduct

You agree not to:

Violations may result in immediate cancellation, termination of access, and denial of future service.

10. Refund Policy

10.1 No work started: You may be eligible for a refund, minus non-refundable processing fees charged by payment processors, where permitted by law.

10.2 Work started or assigned: Refunds are not guaranteed. Partial refunds, credits, or discretionary resolutions may be offered depending on the circumstances.

10.3 Chargebacks: Initiating a chargeback without contacting support may result in immediate service denial, account blacklisting, and recovery actions to the extent permitted by law.

10.4 Refund decisions are made on a case-by-case basis, considering work performed, costs incurred, and operational impact.

11. Disclaimers

11.1 The Website and Online Service are provided “as is” and “as available.”

11.2 We make no warranties regarding uninterrupted service, accuracy, guaranteed outcomes, or completion time.

11.3 You acknowledge that boosting and account access may violate publisher terms. You accept all risks of bans, suspensions, resets, loss of items, or loss of progress.

12. Limitation of Liability

12.1 To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages.

12.2 The Company’s total liability for any claim shall not exceed the lesser of: (a) the amount paid for the specific order giving rise to the claim; or (b) $100 USD.

12.3 Some jurisdictions do not allow certain limitations. In such cases, limitations apply to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless the Company and its Boosters from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Website or Online Service; (b) your violation of these Terms; (c) your violation of third-party rights or terms; or (d) disputes, chargebacks, or claims caused by your conduct.

14. Intellectual Property

14.1 All Website content, code, design, and materials are owned by the Company or its licensors and are protected by applicable intellectual property laws.

14.2 You may not copy, distribute, modify, or commercially exploit any materials without prior written permission.

14.3 We are not affiliated with, endorsed by, or sponsored by any game publisher, platform, or developer. All trademarks belong to their respective owners and are used for identification purposes only.

15. Copyright Complaints

15.1 We respect intellectual property rights and will respond to valid takedown notices in accordance with applicable law.

15.2 Submitting knowingly false infringement claims may result in legal liability.

15.3 To submit a notice, contact us through our support channel with sufficient detail to identify the allegedly infringing material.

16. Governing Law and Venue

16.1 These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles.

16.2 Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Georgia, and you consent to such jurisdiction and venue.

16.3 Any claim must be brought within one (1) year after the cause of action arises, to the extent permitted by law.

17. Changes to Terms

17.1 We may update these Terms at any time. The “Last updated” date reflects the latest revision.

17.2 Continued use of the Website after changes become effective constitutes acceptance of the updated Terms.

18. General Provisions

18.1 These Terms constitute the entire agreement between you and the Company regarding the Website and Online Service.

18.2 If any provision is found unenforceable, the remaining provisions remain in full force and effect.

18.3 Our failure to enforce any provision does not waive our right to do so later.

18.4 We are not liable for delays or failures caused by events beyond our reasonable control (including outages, updates, platform changes, labor shortages, and force majeure events).
